Decision on Admissibility and Merits, Case No. U-27/22

Ruling on requests lodged on 11 October 2022 by Presidency member Zeljko Komsic and on 26 October 2022 by Presidency member Sefik Dzaferovic, the Constitutional Court held on 23 March 2023 that the Amendments to the Constitution of the Federation of Bosnia and Herzegovina (Official Gazette FBiH 79/22 and 80/22) and the Law on Amendments to the Election Law of Bosnia and Herzegovina (Official Gazette BiH 67/22), both imposed by High Representative Decisions 06/22 and 07/22 of 2 October 2022, are compatible with Articles I(2), II(2), II(4) and III(3)(b) of the BiH Constitution, Article 1 of Protocol No. 12 to the European Convention, Articles 5 and 7 of ICERD and Article 25 of the ICCPR. The Court had earlier, on 1 and 2 December 2022, dismissed the applicants' requests for interim measures suspending implementation of the election results.
