Decision No. 97 on the complaints of Valentīns Jeremejevs, submitter of the candidate list of the political party Tautas varas spēks, against the decisions approving polling-station protocol results

Adopted on 10 October 2022 and published in the official gazette Latvijas Vēstnesis on 14 October 2022, this decision dismisses 38 complaints filed on 5 October 2022 by the submitter of the Force of People's Power candidate list against the approval of vote-counting protocols in 80 Riga polling stations (Nos. 1000 to 1080, excluding No. 1006). The commission found the complaints identical apart from the station numbers and joined them. They alleged that protocol-approval decisions were not published or notified, that the IT system gave the complainant no access to them, and that technical failures occurred, and asked to inspect the polling-station journals, to have the votes recounted and to have the election declared void in the region and re-run. Applying the Senate's standard from its judgment of 3 November 2006 in case SA-5/2006, that a breach voids a result only where the result no longer reflects the voters' free will, the commission found no breach of voting or counting rules capable of affecting the results and no substantiated evidence. The reproduced text of the complainant's own submission quotes the State Audit Office's 2022 report on the commission's 2021 accounts, including that system acceptance testing was performed by the developer alone and that the developer reported over a thousand system errors; those passages are the complainant's argument and its footnotes, not findings of the commission.
