Re An Application for a Recount of Electorate Votes in the Nelson Electorate [2023] NZDC 24815

On the application of the National Party candidate in Nelson, a District Court Judge conducted a judicial recount under section 180(5)(a) of the Electoral Act 1993, in the presence of the Returning Officer, scrutineers appointed by the candidates and Electoral Commission staff. The recount produced minor variations in the numbers but no difference to the outcome, and the Judge made an amended declaration of the result under section 180(10). The Judge recorded the professionalism and skill of the counters, Commission staff and scrutineers.
