Decision no. 5/E/2024 of 6 March 2024 (Constitutional Council of Senegal)

Seized on 26 February 2024 by sixteen presidential candidates, the Constitutional Council held that the failure of the competent authorities to fix a polling date more than twenty days after its decision 1/C/2024 of 15 February breached their constitutional obligation to give effect to that decision. Exercising what it described as its plenitude of jurisdiction in electoral matters, it fixed the presidential election itself for Sunday 31 March 2024, convened the electorate in Senegal and abroad, and held that the electoral process was interrupted rather than annulled and must continue. It also provided that if the presidency fell vacant before the elected President was installed, the President of the National Assembly would carry the process through.
