Re An Application by Melissa Lee for a Recount of Electorate Votes in the Mt Albert District [2023] NZDC 25093

On the application of the National Party candidate in Mt Albert, a District Court Judge conducted a judicial recount under sections 178(5)(a) and 180(5)(a) of the Electoral Act 1993 in the presence of the Returning Officer, scrutineers and Electoral Commission staff. The recount produced minor variations in the numbers but no difference to the outcome, and the Judge made an amended declaration of the result under section 180(10).
