Election Commission of Pakistan v. Pakistan Tehreek-e-Insaf, Civil Petition No. 42/2024

A three-judge bench headed by Chief Justice Qazi Faez Isa set aside the Peshawar High Court judgment of 10 January 2024 and restored the Election Commission's order of 22 December 2023 declaring Pakistan Tehreek-e-Insaf ineligible to obtain an election symbol under section 215(5) of the Elections Act 2017. The Court held that 'not even prima facie evidence was produced to show that a semblance of elections had been held' inside the party, that fourteen PTI members had complained to the Commission that no intra-party elections took place, and that the Commission had passed more severe orders against thirteen other registered parties, so could not be said to have victimised PTI. The order was made on the day fixed in the election programme for the allotment of symbols.
