Sunni Ittehad Council v. Election Commission of Pakistan, Civil Appeals No. 333 and 334 of 2024 (detailed reasons)

The detailed reasons for the short order of 12 July 2024, made by a majority of eight of the thirteen judges of a Full Court bench, which declared the Election Commission's order of 1 March 2024 ultra vires the Constitution, held that the lack of an election symbol does not affect a party's right to contest, and declared that Pakistan Tehreek-e-Insaf 'was and is a political party which secured or won general seats' in 2024. A Constitutional Bench set the 12 July 2024 judgment aside on review on 27 June 2025, so this judgment no longer states the law. Of 80 returned candidates on a list supplied by the Commission, 39 were declared PTI returned candidates and the remaining 41 were given 15 working days to file notarised statements of party affiliation. The judgment lists the 'unlawful acts and omissions of the Returning Officers and the Commission', including the recording of PTI candidates as independents on Form 33 and in the section 98 notification, and the Commission's unconstitutional Explanation to Rule 94 of the Elections Rules.
