Decision no. 60/E/2024 of 5 March 2024 (Constitutional Council of Senegal)

Conseil constitutionnel du Senegal · March 5, 2024

The Constitutional Council rejected 2 June 2024 as a polling date because it fell beyond the end of the incumbent's term on 2 April 2024, holding that the duration of the presidential mandate is constitutionally intangible and cannot be shortened or lengthened to suit political circumstances. It confirmed that only the 19 candidates validated by its decision 4/E/2024 of 20 February 2024 could stand, refusing to reopen candidate review by way of a consensus reached in national dialogue, and declined to apply Article 36(2) of the Constitution to let the sitting President remain in office after the mandate expired.
