Re An Application for a Recount of Electorate Votes in the Maori Electorate of Tamaki Makaurau [2023] NZDC 24875

On the application of the Labour Party candidate in the Maori electorate of Tamaki Makaurau, a District Court Judge conducted a judicial recount under section 180(5)(a), (8) and (10) of the Electoral Act 1993. The count was carried out by counting staff in the presence of the Judge, the Returning Officer and staff, scrutineers appointed by the candidates, and the Chief Electoral Officer and Electoral Commission staff. The recount produced minor variations in the numbers but no overall difference to the outcome, and the Judge made an amended declaration of the result under section 180(10).
