OAS Electoral Mission in Guatemala Rejects New Attempt by Public Prosecutor's Office to Violate Popular Will

Responding the same day to the Public Prosecutor's Office seeking a declaration that the elections were null, the mission states that articles 234 and 235 of the Electoral and Political Parties Law regulate the grounds for nullity exhaustively and that the reasons alleged do not fit them, that under article 125(c) the Supreme Electoral Tribunal is the only body competent to decide on the validity or nullity of an election, and that the Tribunal had already proclaimed the results and closed the electoral process on 31 October. It addresses the two specific allegations: on the claimed adulteration of tally sheet 4, a comparison with the model published in Agreement 50-2023 shows the information fields identical, with no field added or removed, the only difference being that the model ran to two pages and the printed sheet to one; on the claimed preloading of the TREP, the mission verified the zeroing of the databases and repositories at 17:00 and the repository still at zero at 18:00 on election day. It also records a new request to withdraw the immunity of President-elect Bernardo Arevalo and members of Movimiento Semilla.
