European Union Election Observation Mission to Guatemala, General Elections 25 June 2023 and Presidential Run-Off 20 August 2023: Final Report

The mission, 136 accredited observers on 25 June and 120 on 20 August, found the TSE organised both rounds professionally and efficiently, and that the Constitutional Court-ordered repetition of the departmental tabulations, concluded 6 July, produced only minor modifications that confirmed the outcome announced on election night. Its summary treats the disqualification of two presidential and one vice-presidential candidacies (Carlos Pineda, Roberto Arzu and Jordan Rodas) as an unreasonable limitation on the right to stand, while the body of the report lists a third presidential candidacy, Oscar Castaneda of Poder, among those made ineligible. It documents more than forty FECI actions against the TSE, two raids on TSE premises on 13 and 20 July, a raid on Semilla headquarters on 21 July, and the seizure of the tally sheets of all five elections. Annex 5 reproduces the official results as certified by the TSE: Arevalo 2,442,718 votes (60.91 per cent of valid votes) to Torres 1,567,664 (39.09 per cent), and a first round, tabulated from TSE Decision 1328-2023, in which the percentage column is expressed as a share of the 5,565,598 total votes cast, with null votes (17.33 per cent) and blank ballots (6.98 per cent) together outpolling every one of the 22 tickets. The report's narrative text instead quotes the preliminary shares of 15.86 per cent for Torres and 11.77 per cent for Arevalo, and its run-off turnout and null, blank and invalid figures are footnoted to the preliminary TREP data rather than the final tabulation.
