Ruling on petitions from deputies and from presidential candidates, the Constitutional Council held that Law no. 4/2024, adopted by the National Assembly on 5 February 2024 to derogate from Article 31 of the Constitution, was contrary to the Constitution: by moving the 25 February 2024 presidential poll to 15 December 2024 and providing that the sitting President would continue in office until his successor was installed, it extended the presidential mandate beyond the five years fixed by Articles 27 and 103 and breached the constitutional principles of legal certainty and institutional stability. The decision annulled Decree no. 2024-106 of 3 February 2024, which had repealed the decree convening the electorate.
