Guatemala 2023 General Election

June 25, 2023 – August 20, 2023

Bernardo Arevalo of Movimiento Semilla, who had placed second in the 25 June first round on 11.74 per cent of votes cast, won the 20 August run-off with 2,442,718 votes, 60.91 per cent of valid votes, against Sandra Torres of Unidad Nacional de la Esperanza on 39.09 per cent. What the international observation missions documented was a dispute driven by state bodies rather than by voters: presidential and vice-presidential candidacies were excluded before the first round, the Constitutional Court ordered a repetition of the departmental tabulation that the election law does not provide for, a criminal judge ordered the suspension of the winning party's legal personality during the electoral period, and the Public Ministry raided the Supreme Electoral Tribunal repeatedly and seized the tally sheets of all five elections. The Constitutional Court, the Supreme Court and the Tribunal itself held the calendar in place, the ordered review confirmed the count, the Public Ministry's 8 December request to have the elections declared null did not take effect, and the transfer of power took place on 14 January 2024. International IDEA records that Congress stripped four of the five magistrates who ran the election of their immunity on 30 November 2023 and that a judge barred them from office in March 2024, since when the Tribunal has worked with one magistrate and substitutes.

Two different bases are in play and the sources report each round on its own base. The first-round percentages shown are shares of the 5,565,598 total votes cast, as the Tribunal's Decision 1328-2023 tabulates them in Annex 5 of the EU mission's final report: valid votes were 4,212,460 (75.69 per cent), null votes 964,775 (17.33 per cent) and blank ballots 388,363 (6.98 per cent), so null and blank together, 24.31 per cent, outpolled every one of the 22 presidential tickets; a further 56,832 ballots are listed separately as invalid and excluded from that 100 per cent. The run-off percentages are shares of the 4,010,382 valid votes. Preliminary figures also circulate and differ slightly: the narrative text of the same EU report, and the International IDEA case study, give Torres 881,592 (15.86 per cent) and Arevalo 654,534 (11.7 to 11.77 per cent), against the final certified totals used here. The turnout figure shown is for the first round; run-off turnout was 44.96 per cent, a figure the EU annex footnotes to the preliminary TREP data rather than to the final tabulation. The same 25 June ballot also elected the 160-member Congress, 340 mayors and municipal councils and 20 members of the Central American Parliament, none of which this presidential table represents; in the Congress result Vamos took 39 seats, UNE 28, Semilla 23, Cabal 18 and VIVA 11, with 41 seats spread across twelve further parties. In five municipalities all elections were cancelled after acts of sabotage that disrupted voting or left votes uncountable on 25 June, and the municipal elections there were held on 20 August under Tribunal decree 03-2023.

The OAS mission records that of 41,430 candidates registered as of 22 June, 4,155 (10 per cent) had been excluded, including four presidential tickets, that the resulting uncertainty delayed ballot printing by a month and eroded citizen confidence in the electoral and judicial authorities, and that registered candidacies were still being changed on 23 June, two days before the vote, forcing ballots to be reprinted in two municipalities.

    On 1 July 2023, in file 3731-2023, the Court granted a provisional amparo to nine parties, ordered the departmental electoral boards to convene a fresh scrutiny review hearing and compare the tally sheets, and required the Tribunal to suspend the qualification and officialization of results meanwhile.     A first-instance criminal judge, identified by the IACHR as the Seventh Investigative Criminal Court, ordered the Citizen Registry on 12 July 2023 to revoke Semilla's legal personality within 24 hours; the State of Guatemala later told the IACHR that the order was a precautionary measure under article 82 of the Law against Organised Crime, while article 92 of the Electoral and Political Parties Law prohibits suspending parties during an electoral process.     The EU mission counts more than forty FECI actions against the Tribunal, including raids on its premises on 13 and 20 July and on Semilla's headquarters on 21 July, and records tampering with sensitive election materials and the seizure of the tally sheets of all five elections.     Prosecutors obtained an arrest warrant against the director of the Tribunal's Citizen Registry for not suspending Semilla, and around the announcement of the run-off result sought to have the immunity of the five Tribunal magistrates and of the registry director lifted. The EU mission records that they demanded the names of the more than 5,000 data-entry clerks who processed the provisional results, and of some 28,000 employees of departmental and municipal authorities and polling stations in the department and city of Guatemala; on 22 August FECI gave the Tribunal five days to hand over the names and positions of all polling station members, all reviewers, all data-entry coordinators and all departmental board members, together with the location of every polling station. The OAS mission's statement of 29 September records that the Public Prosecutor's Office had asked for the immunity of the regular and alternate Tribunal judges to be lifted over the alleged crimes of fraud, breach of duties and abuse of authority, and the IACHR records the resulting impeachment proceedings. International IDEA records that on 30 November 2023 Congress stripped four of the five magistrates who organised the election of their immunity, on an Attorney General's complaint alleging corruption in the procurement of the TREP system, that a judge barred those four from holding office in March 2024, and that the Tribunal has since worked with one magistrate and substitutes.

    The mission stated on 12 September 2023 that it had analysed the findings on which the complaints of irregularities in both rounds were based and verified that they were unfounded: there was no evidence that the yellow copies of Document Number 4 transmitted from voting centres in the first round had been altered, and the very isolated tally-sheet errors in both rounds did not change the order of preferences, let alone approach a second-round margin of more than 20 percentage points and almost 875,000 votes. It repeated on 29 September that it found no elements casting doubt on the results, and on 8 December answered the specific allegation that tally sheet 4 had been adulterated by comparing the sheets used against the model published in Agreement 50-2023 and finding the information fields identical, with nothing added or removed and the only difference being that the model ran to two pages and the printed sheet to one. Both international missions separated the administration of the vote from the environment around it. The EU mission, 136 accredited observers on 25 June and 120 on 20 August, found that the Tribunal organised both rounds professionally and efficiently, assessed voting positively in 97 per cent of the 497 polling stations observed on 25 June and as very well or well conducted in every one of the 528 observed on 20 August, and rated counting positively in 42 of 46 first-round and all 51 second-round observed counts, while judging that the registration of presidential candidates had been subject to an arbitrary, political and selective interpretation of the law by the Tribunal, the Supreme Court and the Constitutional Court. The same mission counted eight candidates assassinated during the first-round campaign and none during the run-off campaign. The OAS mission, 90 specialists and observers from 20 countries covering 1,005 polling stations on 25 June, found election day generally peaceful nationwide though incidents of violence forced the suspension of voting in two municipalities, and reported afterwards that democratic stability had been under intense and constant pressure from actors seeking to ignore, delay or reverse the officialization of results.
