Supreme Court of Ukraine, decision of 3 December 2004 on the determination of the results of the presidential run-off

Ruled the Central Election Commission's determination of the 21 November run-off results unlawful and annulled CEC resolutions No. 1264 and No. 1265 declaring a winner. Found that the CEC had failed to examine territorial commission protocols and verify their accuracy, and had announced results without reviewing pending complaints, and that violations of voter list compilation, absentee voting certificates, unequal media access, commission composition and observer access had occurred. Concluded that it was impossible to reliably establish the genuine will of the voters in the national electoral district, and ordered the CEC to schedule a repeat vote. Declined to declare the first-round leader elected.
