Chilima & Anor. v Mutharika & Anor. (Constitutional Reference 1 of 2019) [2020] MWHC 2

High Court of Malawi sitting as the Constitutional Court · February 3, 2020

The five-judge panel unanimously nullified the 21 May 2019 presidential election, finding irregularities — duplicate, tippexed, altered, unsigned and improvised tally sheets — so widespread, systematic and grave that the integrity of the results was seriously compromised. It ordered a fresh election within 150 days and held that 'majority' in section 80(2) of the Constitution means 50% + 1 of valid votes cast.
